Well, you can’t prove that she isn’t, so by Mann’s Rules of Science, the judge is in the tank.
The quote in the article about the point of the lawsuit is to make it legally impossible to question the theory except by empirical research is quite good and a strong reason for ruling in favor of the defendants. If Mann actually won, it leaves the politics at required acceptance. I don’t think Mann will win even if the new judge is in the tank as well, but the point of intimidation will be achieved never the less. Fight that.
