  1. This sue-and-settle junk has been going on for years. Used to be an open secret, now not so open.

    The weird thing is, with all the FOIA activity involving EPA correspondence, why isn’t this showing up? Nobody’s found an email that says, “we want this regulated, could you please sue us, Wednesday would be good” or something like that.

    Since this sort of thing isn’t showing up, that means they know it’s sleazy and they do it during lunch, on the golf course, etc. instead. They ain’t leaving fingerprints anywhere so far.
