The above is correct. James Madison, called the father of the U.S. Constitution, made it clear that the powers of the federal government are defined and limited and the powers of the state governments are more general. When asked to add amendments to make sure of protection of rights, his response was why tell the government what it can not do when it has no power to do them. He ended up writing what we know as the bill of rights. Article 1, section 1, starts out with: “All legislative powers herein granted….”. The Constitution has not been amended to allow the E.P.A. even to exist.
