  1. one more bigger doc–that includes the admisions by EPA researchers that they are doing small particle human exposure experiments because their small particles premature death epidemiology isn’t proof of anything.
    that’s in the devlin declaration under penalty of perjury.
    This is in spite of their testimony before congress that small particles kill hundreds of thousands of people every year.

    however, never, in my experience, have I seen an adequate challenge of the bad tox and epidmiology–wanna know why–because lawyers are too damn lazy to get up to speed and they are intimidated by the idea of challenging the army of white coats.

    read these essays to see what I am talking about.
    then look back on all your experience and see if you can remember one lawyer who was conversant with the Reference Manual on Scientific Evidence, and the scientific guidance on epidemiology and toxicology that is violated by the EPA research all the time.
    Also how many lawyers did you see who were conversant with how to use the Rules of Evidence and the Daubert jurisprudence to create, in a hearing or a trial, evidentiary challenges that would carry the day and eliminate junk science by the EPA or create an evidentiary ruling issue on appeal.
    they always want to argue about process, constitutional issues, property rights, economic burdens, but they will always lose because even they think that the EPA claims about saving lives is valid and is based on reliable evidence–it’s not, they don’t have a thing but pounding the table and claiming they are saviors.
    Anyway, you are a serious guy, might take an hour to read these short essays. your experience and knowledge is invaluable to this battle and who knows, you might see some interesting and helpful things that we have missed.

    Business/industry people do their best to limit the cost of compliance but will go along with the rule because they believe it is less costly and creates less negative publicity. In addition, the larger the business/industry, the easier it is to absorb the cost compared to competitors. Civil penalties and fines are not usually litigated because it is generally less expensive to negotiate the fine down and sign the consent order with the “I didn’t do it and promise not to do it again” clause. Going to court and litigating this stuff is more expensive and more bad publicity. The regulators know this and are more than willing to have the big press conference, get the bean in their jar, then negotiate the reduced fine. I was involved in a complaint by EPA years ago that somehow ended up before an Administrative Law Judge. We won. The costs were substantially higher than the $250k fine and it only took 4 years to settle the case.

    one thing that I find terribly disappointing is how people coming into business are just willing to accept the EPA word.
    And I am always disappointed to think that physicians won’t participate in the battle to stop these nannies and their junk science.

  6. There is not anything particularly new about the deluge of environmental regulations. 20 years ago we were talking about more regulations covering less and less. Each round of regulations uses the same logic and backup (save some number of theoretical lives, save untold billions in health care costs). I remember Browner doing her darndest to ban chlorine for sterilizing wastewater. The cure was worse than the disease. It was such a joke that we were covering up Cl on periodic tables. This is just the latest assault. The bad part of this is that once implemented, it is very unlikely that the regs can ever be rescinded. The Democrats want more and more and the Republicans will do nothing more than complain. The R’s are constitutionally incapable of withstanding any publicity that might suggest that they are anti-environment.
    I started environmental management (writing applications doing compliance programs, never-ending reports) as an additional duty 30 years ago, it evolved into something I do full time. Every time I can’t believe the regulatory system can get any more idiotic, they prove me wrong. I decided a few weeks ago that it was time to let the kiddies have fun with this idiocy.
