The Obama EPA may never have another Senate-confirmed administrator.
Politico reports:
“It absolutely paints a bigger target on her back,” one oil industry lobbyist told POLITICO. “It was 50-50 she was getting across the finish line without Tuesday’s speech. My read now is that the White House is willing to kiss her goodbye with this upcoming announcement. What political harm would accrue to a coal state senator putting a permanent hold on her?”

To give him the benefit of the doubt, and accounting for the fact that he is a politician, his only face-saving exit strategy is to issue something that looks scary on paper but does no actual harm to the target industries. That way, he has a chance to appease the morons that voted him in. That is, of course, assuming he is not a total dumbwit with a penchant for destruction.
The only reason that Obama needs someone to head the EPA is so that their terrible policies which cause economic ruin can be blamed on someone else while he denies any knowledge.
