Court denies power industry request to advance US EPA mercury case

A deadline was requested so construction could be planned. The court refused saying the EPA might take the plant’s plight into consideration.

“Allowing the agency to reconsider these issues as raised by industry separately ‘may obviate the need for the court to adjudicate challenges to EPA’s startup/shutdown standards,’ the agency told the court in a Sunday 6 filing.” [Platts]
