If you have read EPA final rules and discussions of comments, you will find this is nothing new. I’ve found that the EPA has historically denied any comment that runs contrary to their desire for the rule. In the BIF rules about 20 years ago their response to the Science Advisory Panel’s negative comments was essentially “we disagree and will ignore the comments.” Other than “stakeholders” wanting stricter rules and EPA giving in a bit, the EPA generally goes it’s merry way.
